A Study On Compensation For Spiritual Damage In Tourism Contract Breach

At the beginning,this article defines travel contract and moral damage compensation,justifies the adoption of moral damage compensation in travel contract infringement and further refutes and demonstrates the denied view.This article also purposes that moral damage compensation for tourists may be provided conditionally.Then this article elaborates that no moral damage compensation for travel contract infringement is provided by statutes at present and judges also are confronting similar dilemmas when related issues need to be handled.In the last part,it is suggested that we take reference of experience from United Kingdom and the United States,in other words,by means of naming travel contract and stipulating mental damage compensation for the breach of travel contracts,and construct a whole system for moral damage compensation in travel contract by interpreting the “damage” in Contract Law.Finally,this article reaches the conclusion that our legislation system can be supportive of compensation for moral damage in travel contract with particular conditions.
