Research On Maritime Administrative Coercion

With the development of new economy form,shipping industry plays more and more important role on economic development.Maritime safety supervision is becoming more and more attention by the public.Maritime affairs administration management changes as the adjustment of our national maritime affairs management policies.The importance of maritime administrative coercion system emerges.Administrative coercion law provides a basic guide for the maritime administrative coercion.But because of the complexity and universality of maritime activity,make the maritime administrative coercion should grasp the theory and relevant laws,to achieve an effective administrative coercion implementation.This dissertation consists of five chapters.Based on the common law theories and relative laws and rules,it analyzes and discusses the current situation of maritime administrative coercion and put forward several suggestions to consummate the maritime administrative coercion system.The first chapter introduces the general theory of administrative coercion and analyzes the characteristics and principles of maritime administrative coercion.The second chapter introduces and analyzes the current situation of maritime administrative coercion from two dimensions of administrative coercive measure and administrative execution.The third chapter analyzes some important and difficult concepts of he maritime administrative coercion such as displacement of fulfillment and implementing administrative coercive while handling the major maritime accident.The fourth chapter introduces respectively the maritime administrative coercion system of Britain and Japan,especially in the legislation.The fifth chapter puts forward the suggestions to consummate our country's maritime administrative coercion system:improve the maritime compulsory administrative legislation system,integrate the water law enforcement agencies,perfect the method of maritime administrative execution.
