Research On The Legal Issues Of Personal Injury Compensation In Rural House Construction

In recent years,an important goal of China is the New Socialist Countryside Construction,of which rural house construction is also an important part.However,because of ambiguous stipulations and irregular management of rural house construction market,there are many difficult legal issues in rural house construction and one of the most difficult issues is the personal injury compensation.Based on 141 judgments about legal issues of personal injury compensation in rural house construction,this essay conducts an empirical research on the characteristics and judicial practice of such issues,and do some theoretical analysis on some difficult problems such as legal relationship between or among different parties,legal application,Liability Undertaking when constructors get hurt and so on.This essay aims to make the recent judicial practice of such issues come into essential unity,protecting the legal rights and interests of each party fairly and equitably.Apart from introduction and conclusion,this essay consists of 4 parts.The first part is an empirical research on legal issues of personal injury compensation in rural house construction.Through reading 141 judgments about such legal issues,this part concludes the characteristics and judicial practice of such issues and digs out problems in recent judicial practice.The second part analyses the legal relationship between or among different parties in legal issues of personal injury compensation in rural house construction and distinguishes the legal relationship between the house owner and the construction organizer,he legal relationship between the construction organizer and the constructor.The third part analyses whether other parties need to undertake the liability of damage and how they undertake the liability when one constructor gets hurt in the rural house construction.The last part gives some advice on the recent judicial practice of legal issues of personal injury compensation in rural house construction from two different aspects,aiming at protecting the legal rights and interests of each party and promoting justice.
