Research On Regulation Of China's Agricultural Subsidy

The government must support agriculture by subsidies to maintain national stability and the pleasant living for people basis on its weak quality,although the agriculture serves as the basis for human existence and economic development,irreplaceability industry.Subsidies as the main means of supporting agriculture by the government or public institutions providing financial aid,is one of the main measures for a country to safeguard its food security and adjust of agricultural products market be failure,and also an important measure for income redistribution,raising the whole income level of farmers.The agricultural subsidy policy of our country has been appeared since the founding of New China in 1949.After entering the 21th century,our country opened the overall change of regurgitation-feeding of the industry for the agriculture,implemented a series of agricultural subsidy policy that the subsidies range and aggregate was increasing year by year,and preliminary established the basic framework of agricultural subsidy system.But there still exist some obvious defects about the subsidy,such as low subsidies aggregate,less reliable,the lack of a complete legal system of agricultural subsidies,weak transparency,poor legal liability investigation mechanism and so on,which not only prevent the valid realization of aim,but may lead to the occurrence of corruption and defraud behavior.This article uses our nation's agricultural subsidy laws and regulations as its research objective;it mainly starts from the following aspects:the first part gives a brief introduction on the background,content,object and literature review of agricultural subsidy laws and regulations.The second part defines the connotation of agricultural subsidy and explains its development history and theoretical basis.The third part analyses the development and current status of our nation's agricultural subsidy system and reveals the problems existed.The fourth part proposes advice on our nation's agricultural subsidy laws and regulations;it proposes that we should use American,European Union and Japan's agricultural subsidy laws and regulations for reference,and that our nation's agricultural subsidy legislation should adopt special legislation to improve efficiency,to build an organic,unified,dynamic and open agricultural subsidy legal system that uses Agricultural Subsidy Law as its basic core and uses relevant law and single law as its backbone such as Agricultural Investment Law,Agricultural Insurance Law,Rural Finance Law,etc.Under the guidance of the principle of protecting the interests of agriculture,rural areas and farmers,taking into account the principles of sustainable development,food security,environmental protection and the maintenance of good ecology,the paper proposes that the capital source of agricultural subsidy,the amount budget,the subsidy project,the decision-making subject,the distribution subject and the distribution process should be carried out unified standards and regulations in terms of legislation.Based on the functions of agricultural subsidies,China's agricultural subsidies can be divided into direct income subsidies,subsidies of enhancing agricultural production capacity,rural finance and agricultural insurance subsidies and rural social security(pension)subsidies.Meanwhile,we should pay much attention to the openness of policies related to agricultural subsidies,increase publicity,increase the transparency of agricultural subsidies and pay attention to establish a sound accountability mechanism,so as to improve the accuracy and timeliness of agricultural subsidies and maximize the multiple functions of subsidies for agricultural development,rural stability and farmers' wealth.
