Research On The Joint Negligence Crime And The Responsibility

According to the Criminal Law in the People's Republic of China,the offense of joint negligence is not joint crime.While,in the judicial practice,there are so many cases connected with the theory of the negligence of joint crime.Actually some criminal cases do not led by the individual or several people deliberately,but by two or more components of joint negligence,and the increasingly joint negligence crimes can not be ignored,so I thinks that the study is necessary.In addition to the negligence of joint crime cases,there exist problems about how to divide responsibility,how to convict of a crime.To solve these problems,we need Systematically analysis.So this article is focused on the research of joint negligence crime,the responsibility of joint negligence crime,looking forward to make contributions to our criminal law.In this paper,the authors have had five years working experience in the People's Procuratorate,according to a case of practice,raising the basic problem of whether negligence joint crime constitute the joint crime.Secondly,refer to the Chinese and foreign literature,and the theory through the other countries and regions of criminal negligence,to analyze the advantages and disadvantages,in order to pointed out my point.
