A Study On "The Administrative Procedural Law" In Taiwan,China

The “administrative procedural law”in Taiwan,China,brings together the essence of the administrative procedural law of various countries,so it is unique in comparison with the administrative procedural law of other countries or regions in the world.And because the Taiwan area of Chinese legal and China mainland are related,specifically,the Taiwan area of China and China,similar cultural background,historical tradition,legal system and other objective factors.Therefore,the “administrative procedural law” in Taiwan area of China is the object of this study.Since the promulgation and implementation of the “administrative procedure law” in Taiwan,the rights of citizens have been effectively guaranteed.The purpose of this paper is to study the Taiwan China administrative procedure legalization and its basic contents,and summarizes its experience,and discusses the legislation of administrative procedure in mainland Chinese road based on the summary of Taiwan area Chinese administrative procedure law on the experience.This paper is divided into four parts.First of all,the author first discusses the emergence and development of the “administrative procedure law” in Taiwan region of China;Secondly,it introduces the basic content of the “administrative procedure law” in Taiwan area of China;Thirdly,analyze and evaluate the administrative procedure legalization and its implementation in Taiwan area of China;Finally,it summarizes the experience and shortcomings of the administrative procedure legalization and its implementation in Taiwan area of China,and probes into the legislative work of the administrative procedure in mainland China on the basis of its experience and shortcomings.The process of legalization of administrative procedure in Taiwan area of China is not a smooth sailing,but a process of gradual revision,supplement,development and finally perfect.Therefore,if we are to carry out the administrative procedure legislation in mainland China,we should take the Taiwan region as a mirror and take into consideration the environment of social and historical changes.In the area of Taiwan China administrative procedure law as reference,should go to its dregs its essence,combined with the actual environment,Chinese,optimal allocation in order to achieve the administrative resources effectively,the administrative procedure legislation to work.
