On The Application Of China's Death Penalty Reduction System

In the past 20 years,abolish the death penalty has become a global trend of the death penalty reform,combined with its national conditions,not immediately abolish the death penalty in our country,only from applicable way to limit and reduce the complete abolition of the death penalty gradually,achieve our reforms to the death penalty.On the basis of this,it is a new legal system,but it still has more or less problems.The existence of these problems affects the application of the system of death penalty in judicial practice.Therefore,it is worth studying and solving.Specifically,this paper is divided into four parts.In the first part,a brief overview is given to the system of penalty reduction.Through the concept of the penalty reduction system,the legislative purpose and the background,nature,value orientation and function are used to determine the research object of this paper.Death are emphatically analyzed in the second part,restrict the application of the commutation system problems,according to the specific provisions of the law and the relevant academic research as well as guiding cases,combined with trial practice,to specifically describe death limit the applicable premise of commutation,according to the nature,application principle and the specific applicable objects.In the third part,some problems existing in the application of the system of death penalty reduction are emphatically analyzed.In the fourth part,the author puts forward some Suggestions and opinions on the problems existing in the application process.
