The Sentencing Credibility Of Internet Fraud Crime:Evaluation And Standardized Path

As a new type of traditional fraud crime,Internet fraud crime is developing rapidly in recent years,which has the characteristics of low cost of crime,great behavioral concealment,broad scope of the victim,difficulty in detecting crime and great social harmfulness,etc.Once succeeds,it will bring huge economic losses to people,and have a big impact on economic security and stability of the society.The theoretical circle's researches on the Internet fraud crime mainly focus on the study of criminal means,characteristics and other theories of crime ontology.But for the empirical study of penalty discretion of Internet fraud crime,it is still in a state of lack.Due to the fact that China has not yet formed a mature and unified measure of sentencing rules and sentencing methods,the situation in judicial practice that the same cases have different punishments is not uncommon,which keeps the sentencing credibility down.Therefore,it is necessary to study the evaluation of sentencing credibility of Internet fraud crime by discussing the general principle of sentencing credibility,analyzing and evaluating the factors of sentencing of Internet fraud crime,and learning from the experience of the standardization of sentencing in other countries.Through the above researches,the author puts forward the path of Chinese sentencing standardization of Internet fraud crime for enhancing sentencing credibility.This paper is divided into three parts:Chapter 1,The general theory of sentencing credibility,which includes defining the relevant concepts of sentencing credibility,analyzing the evaluation's functions of the sentencing credibility,and determining the evaluation's standard of sentencing credibility.Chapter 2,The analysis on the factors of the evaluation of sentencing credibility of Internet fraud crime in China.Makes an empirical study on the judgments of Chinese Internet fraud crime with statistical principle,analyzes the factors that affect the sentencing of Chinese Internet fraud crime by combining theory,and determines the factors of the evaluation of sentencing credibility of Internet fraud crime in China.Chapter 3,The improving path of sentencing credibility of Chinese Internet fraud crime.In view of the problem in the sentencing process of Chinese Internet fraud crime that the same cases have different punishments,and combining with the result of empirical research on analyzing factors of sentencing,explores the path of Chinese standardization of sentencing of Internet fraud crime to improve sentencing credibility of Chinese Internet fraud crime,which includes the rationalization of sentencing standards for Internet fraud crime and constructing an information system for Internet fraud crime's sentencing.
