Civil joint and several liability is a kind of particular system in civil law,whose value lies that it can protect the creditors' rights fully and timely.For its advantage above,civil joint and several liability has been paid worldwide attention in the legislation of civil law in many countries and been more and more widely used in Chinese judicature.Look over the whole process of civil joint and several liability in Chinese judicial practice,the traditional judgment and enforcement procedure are uncertain and confusing in some areas.Therefore,it's necessary to make deeply and materially study on the problems,based on the date analysis of academic researches,legislation and especially judicial cases in People's Court of Hailing in Jiangsu Province from 2005 to 2016.We need to appropriate express the rights of various parties in the balance of interests and interactive relationship between rights and obligation in the judicial adjudication and executive procedure.
