A Study On The System Of Making Blood Support For Blood Relatives

The pro-blood kinship is a new type of social relationship based on the breakdown and reorganization of the original family in the wave of Chinese society's progress and mass ideology.At present,China has not formed a special system for the legal norms concerning the imposition of blood and relatives,and it has not established relevant laws and regulations for the pro-blood-related issues.Most of the issues related to blood-related pro-competition can be reflected in some relevant provisions of the “Inheritance Law” and “Marriage Law”.The provisions of the provisions on the pro-blood pro-recognition standards are vague and cannot form a complete system for regulation.However,the incompleteness of this kind of legal regulation is reflected in the fact that the existing provisions on the pro-blood relationship not only do not clarify the criteria for the formation of pro-compatibility,but also deviate from the question of the establishment of the pro-blood pro-independence standard and the expressions are inconsistent.The role of the law is to standardize people's behavior.At present,China's imposition of related laws and regulations related to blood and blood is not standardized,which will lead to the law of the establishment of the pro-blood system will not become the standard for guiding judicial practice,and cannot play the legal function.The author studied this issue during postgraduate studies,wrote a large number of relevant journals,and then wrote the article,hoping to do a little research on the issue of perfecting the system of cognizance.This thesis is divided into four chapters to demonstrate the issues related to the establishment of the proscribed blood cousin:First,starting from the existing typical cases in our country,we analyze the results of case trials and raise related issues,namely,the determination criteria for the establishment of the pro-blood system,and what factors should be used as the support for the parent-child support system.Second,the relevant regulations and views on the establishment of the pro-blood relationship were explored in the academic community and in practice in China.The focus is on the existing theoretical perspectives on the establishment of the pro-blood relationship and the publication of their own opinions based on the views and opinions of relevant scholars.Third,the legislation of countries outside the region draws on.In this article,from the relevant foreign legislation,we look for other countries' relevant legislation on the establishment of the pro-blood kin system,analyze the legislative trend,and find and learn relevant systems that suit China's national conditions from its legislation and practice.Fourth,a clear definition of the pro-blood family's establishment criteria.Formulate the criteria for the identification of pro-blood kinship and put forward legislative proposals for the establishment of pro-system blood pro.
