Star Privacy Protection Law Studies

Since the reform and opening up,China’s political,economic,cultural and social aspects have made great achievements,along with the progress and development of all aspects,people’s spirit demand for cultural entertainment are also improved,and the star as an important part of this field,draws so much attention in the society.Investigate its reason,not only because star is a public figure,but also the word and action of a star has a certain influence on the whole society,such as has long been hot topics like "celebrity endorsements"and other hot issues of social concern,represents the characteristics of the star is different from ordinary people.However,things have duality,while seeing stars influence on society,the private life of the stars,become the focus of the society,one of the most common is the so-called "paparazzi",often turned upside down to the private lives of stars,produce phenomenon which is out of line.In recent years,however,the stars began to pay more and more attention to their own privacy protection,as the arrival of the news media infringement occurred,actively use legal means to safeguard the legitimate rights and interests of oneself.In real life,star in their privacy protection,of relates in media news infringement,which involves the public’s right to know,the freedom of media and social public interests,the law also tend to judge situation in a dilemma.In 2009,with the issue of《Tort liability law of the People’s Republic of China》,the right of privacy become an independent personality right in law,the contradiction between the right of privacy and news freedom for star temporarily had been settled,but with the rapid development of society and the new situation appear constantly,conflicts between the star of privacy and news freedom problem still couldn’t keep pace with the times,to get a better solution.So this paper at first,defines the freedom of the press and the star privacy on basic connotation and denotation,and make inductive analysis about news media to the star privacy violation mode and characteristics in the real life.Then,using the means of comparative law,the processing method of foreign countries such as Germany,the United States for its celebrity privacy and the press freedom,compares and analyzes the relationship between the principles of management of method,put forward this aspects of legal system in our country.Finally,from the two aspects of legislation to protect the status and problems existing in the practice of star privacy legal protection,carries on the analysis to present situation in our country.Based on this,puts forward suggestions for the perfection of the legal privacy protection in our country,such as refinement of privacy legislation content,clear the components of privacy infringement and the liability way,follow certain rules of judicial judgment,etc.,and hope to realize the unification of three aspects,those are further regulate the behavior of the news media reports,better protect star privacy,to achieve legal essence equality as much as possible,maintain public interests,seek common development and progress of news,the rule of law and human rights cause in our country.
