Study On The Legal System Of Ecological Compensation In Beijing, Tianjin And Hebei

In 2014,general secretary Xi Jinping stressed at the Symposium on cooperation for development in Beijing,Tianjin and Hebei.The coordinated development of Beijing,Tianjin and Hebei is a major national strategy in China.This strategy can be described as profound,sweep down irresistibly from a commanding height.Improving the legal system of ecological compensation in Beijing,Tianjin and Hebei is an important content and effective way to promote the coordinated development of Beijing,Tianjin and Hebei.In the third Plenary Session of the 18 th CPC Central Committee,the party put forward: "to build an ecological civilization,we must establish a systematic and complete system of ecological civilization and protect the ecological environment with the system." We should improve the property rights system of natural resources,implement the system of paid use of resources and the system of ecological compensation,and reform the management system for the protection of the ecological environment.This has pointed out the direction for improving the legal system of ecological compensation.At present,the destruction of natural ecology is serious,which restricts the coordinated development of Beijing,Tianjin and Hebei.The study of the legal system of ecological compensation in Beijing,Tianjin and Hebei is a very important and urgent research topic at present.From the practice of Beijing Tianjin Hebei,combining ecology,economics and law and other disciplines,the use of normative analysis,the internal theory of jurisprudence of rights and obligations consistent theory and the law economic externality as the theoretical basis of ecological compensation;the use of comparative analysis,comparison of the ecological compensation system by the United States and its essence.And improve the ecological compensation legal system of Beijing Tianjin Hebei;through case analysis,the value system of Ecological Compensation Research of Xin'An River Basin,provide experience for the perfection of ecological compensation system in Beijing Tianjin Hebei region.This paper studies the ecological compensation legal system of Beijing Tianjin Hebei,summarizes the basic category of ecological compensation,ecological compensation comprehensive analysis of Tianjin problems,summarizes domestic and abroad ecological compensation experience,provide suggestions for perfecting the legal system of ecological compensation in tianjin.Inaddition to the introduction and conclusion,this paper is divided into four parts.The first part is the overview of the legal system of ecological compensation in Beijing,Tianjin and Hebei.This part expounds the general situation of Beijing Tianjin Hebei ecological compensation legal system from many angles,clarifies the legal concept and characteristics of ecological compensation,and provides theoretical basis for improving the legal system of ecological compensation in Beijing Tianjin Hebei region under the background of regional cooperation.The second part is the existing problems of the legal system of ecological compensation for Beijing,Tianjin and Hebei.In this part,from the legal system legal system overall and specific comprehensively expounds the existing Tianjin ecological compensation legal system,analyzes the current Tianjin ecological compensation legal system is facing difficulties and challenges,for the development of eco compensation measures lay a basis for the next step.The third part is the practice and reference of the legal system of ecological compensation at home and abroad.By analyzing the legal system of ecological compensation in the Xin'An River Basin and the ecological compensation system in the United States,and comparing the legal practice of ecological compensation at home and abroad,this paper expounds the experience that we should learn from improving the legal system of ecological compensation in Beijing Tianjin Hebei.The fourth part is the perfection of the legal system of ecological compensation for Beijing,Tianjin and Hebei.It is the core of this article.Based on the above analysis,the author separately from the whole legal system and the specific legal system put forward to perfect Tianjin ecological compensation legal system is proposed,including: the establishment of the constitutional status of ecological compensation,to establish special "Tianjin Ecological Compensation Ordinance",to promote the Beijing Tianjin Hebei coordinated legislation,the establishment of ecological tax system,establish the budget system of ecological compensation the establishment of Beijing Tianjin Hebei,while the development of compensation system,the establishment of water rights trading system of Beijing Tianjin Hebei,Beijing Tianjin Hebei attach importance to ecological compensation policy and other legal assistant.Through these two major measures to improve the legal system of ecological compensation in Beijing,Tianjin and Hebei,in order to contribute to thecoordinated development of Beijing,Tianjin and Hebei.
