Research On Improve The Secrecy Censorship In Government Information Disclosure

Since the 18th CPC national congress,China has been constantly innovating and becoming more rigorous in promoting the transforrmation of government functions from administrative government to service-oriented government.Throughout the governments around the world are advocated to establish a transparent,sunshine government,and establish the government information publicity system,is becoming the leading democratic countries actively promote and set up the government image.However,in the process of implementation,the degree of perfection and the degree of democracy of various countries directly affect the openness of government information.Information confidential examination mechanism as the supervision of the government information publicity system,should be in the government information disclosure on what circumstances can be regarded as state secrets,to play a more important role on the specification confirmation process.The development of government information disclosure system is directly influenced by the performance of the secrecy review system,the degree of system improvement and the availability of relief system.Relative to our country in the past 5000 years has a history of feudal dynasty rule,after the founding of the people' s need to obtain government democracy,transparency and the rule of law in the people thought the time is too short,germination of government agencies in the public eye is covered with mysterious veil,and always let a person fear to numb.With the spread of the concept of the rule of law and the popularization of legal knowledge,the rule of law became the government's goal after the 18th national congress of the CPC.The government of the People' s Republic of China(hereinafter referred to as the "regulations")has finally ushered in a new sunrise.Due to the earlier published the regulations,in today' s network under the background of popularization,some flaws and the insufficiency of legislation and system is gradually exposed,need further perfect and related supporting mechanism to perform together.It is the key to the transformation of our administrative philosophy and the establishment of true sunshine government.This paper mainly introduces the study of the secrecy censorship in government information disclosure through three main chapters.First is through the analysis of government information disclosure confidential examination mechanism in the related theoretical basis,the use of in-depth information published and relation of contradiction and opposite state secrets,and then points out the mechanism of government information disclosure and confidentiality review mechanism,the relationship between provides the credible theoretical basis for the paper is written after.Secondly,pointed out that China' s current government information release confidential examination mechanism in the current situation and the problems arising from the execution process,using the method of normative analysis and empirical study method fusion,this paper expounds the China confidential examination mechanism deficiencies and problems.Finally is using the method of comparative analysis contrast some western developed countries in the confidentiality review relevant legal experience and results,points out that the government information disclosure confidential examination mechanism problems in the mechanism,thus put forward response,contain certain audit subject,audit process,audit standards,to improve the oversight system for confidentiality review and improve the confidentiality review consequences rescue mechanism,etc.At present,most scholars in China focus on the government information disclosure system,and the research on supporting mechanism is less.The author try to take advantage of government information publicity in the confidentiality review system as a breakthrough point,from the theoretical level to explore the theoretical basis of confidentiality review system and follow the principles,analyzes China' s current implementation of the new "secrets act and the regulations,improving opinions are proposed according to the domestic development of the truth.
