Research On The System Of Collective Management Of Copyright Extension

The copyright extension collective management system originated in the nordic countries in the 1960 s.In the creation and dissemination of the work has taken place great changes today,the extended collective management system meets the requirements of the network era for mass work permits.China’s attempt to introduce an extended collective management system in the "Copyright Law"(revised draft)published in 2012 has aroused heated discussion from all walks of life.This paper systematically introduces the collective management system of copyright extension,clarifies the necessity and rationality of introducing the system in our country,and puts forward some legislative suggestions on the problems that China may introduce the system on the basis of summarizing the experiences of the Nordic countries.The contents of this article are as follows:The first chapter is the discussion of the necessity and feasibility of constructing the collective management system of copyright extension.This chapter first introduces the definition,nature and characteristics of the copyright extension collective management system.On this basis,it discusses the legitimacy of the collective management system of copyright extension.Secondly,it analyzes the shortcomings of the traditional collective management model of copyright,and the status quo of the collective extension of collective management system in our country.It is urgent to construct the collective management system of copyright extension.And on this basis,discusses the potential benefits of building an extended collective management system.The second chapter is the problem that the collective management system of copyright in China can face.On the basis of pointing out that China has necessary to construct the collective management system of copyright extension,this chapter analyzes a series of problems that China may face in introducing this system.Such as the strong administrative color,the license fee collection and distribution problems,non-member copyright owner’s rights and interests of the existence of difficulties,supervision and dispute resolution mechanism and so on.The third chapter is the reference for the collective management system of copyright in the Nordic countries.This chapter first introduces the collective management system of copyright in northern Europe,and takes Denmark and Norway as an example to analyze the construction of the collective management system of copyright in the two countries,and compares it with the institutional environment of our country.The fourth chapter puts forward the legislative suggestion to construct the collective management system of copyright extension in our country.First of all,this article gives a brief comment on the contents of the copyright collective management system in China’s Copyright Law(Revised Draft),and clarifies the scope of application of the copyright extension collective management organization,clarifies the "representative" of the collective management organization,The protection of the interests of non-members of the copyright owner,and the supervision of the collective management system of the copyright extension,and put forward the legislative proposals to construct the collective management organization of copyright in China.
