Perfection Of Defective Product Recall System In China From The Perspective Of Law And Administration

With the development of commodity economy and the improvement of consumer rights and interests,the defective product recall system has been produced.The system originated in the United States,and China began to implement this system in 2004.In recent years,the product recall system plays an increasingly important role in protecting the legitimate rights and interests of consumers,improving the product quality of products and promoting fair competition in the market.To a certain extent,defective product recall system has become an important way for the government to carry out macroeconomic regulation and control.As a legal system and administrative supervision,research on China's product recall system has important theoretical and practical significance.This paper takes the defective product recall system as the research object,through the legal and administrative two different perspectives,starting from the background and concept of the recall system,combined with the author's practical experience,elaborates the present situation of the implementation of the defective product recall system in China.By comparing the domestic and international recall system in the laws and regulations,system design,management system and other aspects of difference,we found many problems in the implementation process of product recall system in China and try to put forward suggestions on improving the recall system of defective product from the legal and administrative levels.This paper is divided into four parts.The first part introduces the background and significance of the topic,the research status at home and abroad,and the research methods of the dissertation.The second part elaborates the basic concept of recall,the type of product defect and the difference between recall and related system,forming a more complete theoretical fi-amework of recall system.The third part,through the data statistics,comparative research,empirical analysis and other methods,analyzes the present situation of the product recall system and the main problems in China.The fourth part,according to the problems of the defective product recall system in our country,from the legal and administrative level,put forward ideas and suggestions to improve defective product recall system in China.
