Meanwhile,as a new system,pretrial conference in the operation of S province has exposed defects of functional expansion,imbalance between the prosecution and the defense,inequality of participation between the prosecution and the defense,high rate of regret about agreed items and influence the evaluation of the efficacy of pretrial conference.The reasons for these defects are related with the misunderstanding of purpose of participating in pretrial conference,function of pretrial conference and role of participating in pretrial conference.In order to solve the above-mentioned problems of the procuratorial organs' participation in the pretrial conference,on the one hand,prosecutors need to further clarify the purpose of participating in pretrial conference,position the role of prosecutors in pretrial conference accurately,grasp the principle of obtaining information,serving for trial,correcting errors and preventing errors and legal supervision in pretrial conference,fully perform their duties in pretrial conference,and highlight the focus;On the other hand,it is necessary to further improve the system design of pretrial conference from the aspects of the participants,program start and procedural provisions.The original intention of pretrial conference system is to improve the efficiency of litigation and ensure the quality of trial.Under the background of"Trial centered" judicial reform,its function and value is highly expected.This is an important issue in the judicial reform that how to exert the necessity-level function and value of pretrial conference.Through the practice of procuratorial organs in S Province,we can find that there are some obvious characteristics of their participation in pretrial conference,such as the number of cases of pretrial conference is relatively small and local participation is not balanced.During pretrial conference,the procuratorial organs of S province has achieved considerable results to ensure the smooth conduct of the trial,improve the quality and efficiency of prosecution,strengthen the sense of burden of proof and promote litigation justice,etc.And these procuratorial organs has accumulated valuable experience which can be used for reference by other procuratorial organs.
