Research On The Causality Of Environmental Pollution Crime

With the rapid deterioration of environmental problems in China,the state has raised the issue of environmental protection to a very important position,after the civil law,administrative law and other regulations on environmental pollution,The Eight Criminal Amendment further amended the environmental crime from the original major environmental pollution accident crime to the environmental pollution crime,the legal interests and subjective forms of the crime have changed greatly,and these changes put forward new requirements for the study of causality in environmental crimeThe purpose of this paper is to study the causal relationship in the environmental pollution crime.This paper makes a detailed analysis on how to identify the causal relationship and how to operate in judicial practice through theoretical research and case analysis,at the same time,learn from other countries and other parts of the law related to the content of the specific description.The first part of this paper introduces the present situation and the historical evolution of the environmental pollution crime.The second part mainly introduces the problem of how to identify the cause and effect of the common crime,in order to identify the cause and effect relationship in the late environmental pollution crime.The third part mainly introduces the particularity of causality in the environmental pollution crime.,and then from the theory of environmental tort in civil law of our country and the theory of foreign countries to identify the causal relationship between pollution and environmental crime to find specific solutions.The fourth part mainly introduces the three ways of identifying the causality in the environmental pollution crime.
