The Status And Perfection Of Suspected Juvenile Delinquency Probation In Capital Juvenile Procuratorial Work

The juvenile procuratorial organ of grassroots procuratorial in Beijing is to explore the suspected juvenile delinquency probation actively.Social work offices,probation units and other relevant departments,social organizations,division of labor,according to the criminal proceedings involved juvenile circumstances of the crime,the degree of repentance,whether there is a suitable way to study and help and other factors to determine whether it is applicable to the conditions of non-prosecution,and the appropriate protection of the user to help work,that is,by taking a series of targeted measures,such as education correction,follow-up visit,psychological counseling,addiction treatment,etc.,to promote the smooth return of juveniles involved.Among them,the social work firm and the probation units in Beijing inspection departments play a role in the probation work which cannot be underestimated,and more importantly,whether the social organization to provide the appropriate way to help teaching,not only affect the prosecutor to consider whether the application of conditions not to prosecute the important factors,but also determines whether the smooth development of the work.Due to the independent juvenile law and dealing with juvenile court events and other specialized agencies are not founded at the mainland,the procuratorial organs can only meet certain conditions of juvenile crime involving decide to apply conditional non-prosecution,which is a concept of our method,and support,corrective action in,therefore,it is particularly important to make good use of this system.Combined with the research,for making full use of the system,the procuratorate of Beijing has with the relevant departments to formulate the corresponding normative documents,and can be refined in the grassroots procuratorial organs.Enrich the juvenile procuratorial work personnel team,and to coordinate social organizations around the system to carry out the concept of nursing work,forming the supervision inspection education groups gradually under the procuratorial leading,cohesion of social forces involved in the crime of juvenile delinquency correction.At the same time,with the practical work of the system to vigorously promote,the application process also appeared more problems: the lack of specialized legislation and the imperfect existing legal norms cannot adequately limit the discretion of prosecutors,so that the case to determine the existence of risk,discretion does not prosecute the application rate increased,less type of probation units cannot provide appropriate inspection and teaching methods,affecting the conditions of non-prosecution and follow-up probation work carried out.The solution of the above problems is urgently needed by the legislative organs,procuratorial organs and other relevant departments and social organizations to continue in-depth exploration and practice,but also need to rely on family custody to change the behavior of suspected juvenile delinquency.This paper tries to put forward some suggestions on the basis of the investigation,in order to make a modest contribution to the improvement of the juvenile probation system.
