Research On The Relief System For Criminal Victims In China

For a long time,the criminal justice pattern often takes the protection of the rights of suspects and defendants as the center,while ignoring the protection of the rights and interests of victims.Since 2004,our country will " respect and guarantee human rights" to the amendment to the constitution,and then write to the new criminal procedure law in 2012,as one of the tasks of our criminal procedure,show our country's human rights guarantee cause to enter a new mileage,which also shows that we will pay more attention to the care and rescue of criminal victims.With the continuous development of social economy and the progress of social civilization,China began to explore and pilot the criminal victim assistance from 2004,and in 2009,it formally established the national level of criminal victim assistance work in the form of national level,the normative document on the principle of the rescue work for criminal victims,the object of relief,rescue standards and relief agencies.Although China has issued a number of local regulations and relevant regulatory documents,but all of them are on this basis,the criminal victim assistance system in China has been developed and improved at this stage,but not enough.Through exploring the theoretical basis of the construction of the criminal victim assistance system and the local regulations and relevant normative documents of the criminal victim assistance system,this paper reveals the purpose and system status of the rescue of criminal victims in our country.Through the comparative study of the criminal victim assistance system in the relevant countries outside the domain,we can absorb and draw lessons from the advanced experience.At last,according to the specific situation and existing problems of the construction of the criminal victim assistance system in our country,this paper puts forward some suggestions on the rescue mechanism,the object of the relief,the mode of relief,the rescue conditions and the rescue procedures,etc.This paper will mainly from the following four parts of China's criminal victim assistance system to improve the construction of the argument.The first part discusses the concept,basic principles,theoretical basis and value orientation of the criminal victim assistance system in China,so as to reveal the purpose of the rescue of criminal victims in our country,and provide the necessary theoretical support to improve the criminal victim assistance system in China.The second part from the perspective of comparative law to explore the situation of other countries' criminal victims assistance system,from the absorption and reference of outstanding achievements,to improve the criminal victim assistance system in China to explore advanced extraterritorial experience.The third part investigates the current situation of the criminal victim assistance system in our country,understands the specific situation of the construction of the criminal victim assistance system,and finds and analyzes the existing problems in the criminal victim assistance system in our country.The fourth part,on the basis of the previous analysis conclusion,pay attention to absorbing and drawing on the advanced experience of the criminal victim assistance system outside the domain,and combining the basic national conditions of the criminal victim relief work in our country,put forward the suggestion to improve the system of criminal victim assistance in China.
