A Study On Problems And Countermeasures Of Anti-monopoly Law Enforcement In China

For a long period of time in our country,the implement of Anti-monopoly law has not been given due attention.Since the summer of 2014,China's Anti-monopoly law enforcement agencies imposed a huge antitrust fines on number of foreign car companies as well as Qualcomm and other foreign companies.These series of cases has aroused strong concern and heated debate at home and abroad.It Shown that there are some problems of antitrust enforcement.The major problems of Anti-monopoly law enforcement are as follows: the powers of AMEA are not concentrated,the enforcement of Antitrust law is lack of clear procedural standards,the professionalism of Antitrust enforcement officers needs to be improved,the high cost of antitrust private litigation,and the liability regime of Anti-monopoly law needs to be refined.In comparison,In order to guarantee efficient implementation of antitrust law,the international experience of Anti-monopoly law enforcement,such as the United States,European Union,Japan and other countries or regions are worth learning,Which mostly have set up the authority of the antitrust enforcement agencies and a clear anti-monopoly law enforcement procedures,high professionalism of law enforcement personnel as well as appropriate reducing the cost of antitrust litigation,and have adopted punitive damages institutional measures.In order to improve the enforcement of anti-monopoly credibility,and establish long-term mechanism of antitrust enforcement.This paper,combined with China's specific national conditions,puts forwards three major problems and countermeasures of enforcement of Anti-monopoly law,that is,the public enforcement of Anti-monopoly law,the private enforcement of Anti-monopoly law and liability of Anti-monopoly law enforcement.
