With the amendment of the criminal law of the People's Republic of China(eight),the dangerous driving behavior in life is regulated by the newly added"dangerous driving crime".In August 29,2015,the "People's Republic of China criminal law amendment(nine)" the introduction,it is the introduction of the criminal law of drunken driving on the road,vile driving on the road chase driving into criminal behavior,and the driving school car business or engaged in passenger transport,passenger and severe overcrowding speeding and serious in violation of regulations of dangerous chemical safety management of dangerous chemicals transportation,endanger public safety behavior into the "dangerous driving crime",and the provisions of these acts are directly responsible for the owner of the vehicle management,in accordance with the crime of dangerous driving.At present,the"dangerous driving crime" asserting in the judicial practice there are some problems to be solved,especially for the "amendment(nine)" in the new "double super dangerous behavior cognizance and application,no detailed provisions of current law.In order to investigate the dangerous driving crime in the judicial practice and application,this article from the basic concept of the crime of dangerous driving and the legislative background,four types of activities and identification of,and the relation between the crime of dangerous driving and other charges as well as the current situation of judicial practice,discusses the Predicament of judicial practice and put forward the perfect suggestions.
