Since reform and opening up,The villages and towns small-micro enterprises(VTSMEs)of China has grown rapidly,has become the promotion of social productive forces and promote the building of a harmonious socialist society as an important force for 30 years.It plays an irreplaceable role to increase employment,to achieve an active market,to improve people's livelihood and to promote economic restructuring.However,VTSMEs have been always troubled by shortage of funds and difficulties in financing.Although the economy development of our country is steady,but VTSMEs financing is still have no effectively way to solve the financing problem.Because of VTSMEs operating ability is poor,weak ability to resist risks and other reasons,resulting in the channel is not smooth,resulting in VTSMEs financing difficulties,but the imperfection of legal system is the key to produce the financing problems.It is difficult to be noticed to the formal financial institutions to obtain silver fund security money to help,VTSMEs have to turn to the informal financing institutions to solve financing thirst.Informal financing for solving the problem of financing difficulties in promoting VTSMEs,but also the existence of a series of risks.Our country' law in the VTSMEs informal financing problems in the place such as legislation,regulation,guarantees.VTSMEs financing is a folk law in China and outside the formal financial regulators control the financing form,its most financing behavior is still in a state of "underground".Also shortcomings in regulation,regulatory agencies is not clear that VTSMEs informal financing is difficult to get effective management.So to strengthen the legal regulation of VTSMEs informal financing is urgent.Based on the discussion of foreign small-micro enterprises financing based on the legal system,combined with China's small micro enterprise development reality,puts forward the Law Countermeasures of China's small and micro businesses financing.Starting from the concept of small-micro enterprises,The paper explains the theoretical issues related to VTSMEs financing,in order to do necessary theoretical preparation for constructing the legal system of financing of VTSMEs.Through the analysis of the existing legal system in our country,this paper expounds the current legal system of VTSMEs enterprises in our country informal financing,the defects of comprehensive draw lessons from foreign advanced experience,put forward to theVTSMEs informal financing system and the perfection of relevant laws.
