Research On The Penalty To The Crime Of Corruption

This article takes the "The Amendment Ⅸ to the Criminal Law " and "Interpretation of the Supreme People’s court and the Supreme People’s Procuratorate " as breakthrough point,From the change and reform of the legal punishment of corruption crime in China,and reference to Germany,the United States,Hong Kong,Taiwan on the general provisions of the legal punishment of the penalty to the crime of corruption.On the basis of the legal analysis,this study discusses the allocation of the legal punishment of corruption crime in our country,and puts forward some related problems and suggestions.This article is divided into five parts,In the introduction part,the background of " The Amendment Ⅸ" and " Interpretation " is discussed,and a brief introduction to the revision;The second part makes a general investigation on the development of the legal punishment of corruption crime in modern China;The third part analyzes the penalty to the crime of corruption;In the fourth part,the analysis and thinking about the allocation of the crime of corruption;The fifth part puts forward some suggestions based on the analysis and evaluation of the key points of the amendment of the penalty to the crime of corruption in " The Amendment Ⅸ" :Including "life imprisonment" problem and suggestion,the question and suggestion of the qualification penalty,the problem and the suggestion of the legal punishment of the state organ staff are three contents.
