A Study On Compensation For Spiritual Damages Of Tourism Contract

Tourism disputes occurred every year due to the breach of contract of tourism services and the spiritual damage.In the existing legal system,it is very difficult to obtain compensation,or simply cannot get compensation.The above situation has seriously infringed upon the legitimate rights and interests of tourists.Thus,it urgently need for legal support.In this paper,we start from the following parts:The first chapter mainly introduces the system of the tourism contract,compensation for spiritual damage and the spiritual damage compensation of breach of contract.By introducing the concept,characteristic,and controversial views of the system,this paper provides the basic concept supported for this paper.The second chapter mainly expounds the current situation of the spiritual damage compensation in breach of contract based on the investigation of the current situation,theoretical dispute and the practice of foreign tourism contract breach of contract in China.The third chapter focuses on the necessity of moral damage in breach of contract.Chapter four presents the system of mental damage compensation for breach of travel contract in our country building,which is key for breach of tourism contract spirit damage compensation in the civil code in the future orientation,constitution and set in breach of travel contract spirit damage compensation standard.Through the above discussion,the essence of the contract of tourism services is fully demonstrated in effective promotion of the development of the compensation system for breach of contract of tourism services.
