Research On The Settlement For Public-Private Partnership Investment Disputes From The Perspective Of The "One Belt One Road" Initiative

The“One Belt One Road" Initiative is drawing the global attention since it has been proposed by Chinese Government.With the support of the government,Chinese enterprises show their willing and interesting in investment in the countries along the"One Belt and One Road".The first part introduces the possibility of the application of the Public-Private Partnership(PPP)model in investment to the infrastructure of the countries along“One Belt and One Road".By analyzing the“One Belt and One Road" concept and main investment projects,the infrastructure construction will be the basis development in that area.Then combined with the history and advantages of PPP model to summarize that the PPP model can provide a perfect solution for infrastructure.The second part outlines the dispute settlement resolution related to international translation,including the general resolution worldwide and the former cases on Chinese enterprises.The third part introduces the situation of dispute settlement resolution for PPP.The author chose several typical countries’ resolutions for the PPP dispute settlement,including the British mode,the French mode,etc.This part also provided some global organizations’ suggestion for the PPP dispute settlement resolution,for example the World Band and the European Bank for Reconstruction and Development.Then it introduces the current situation of Chinese PPP dispute settlement.The fourth part introduces the potential risks of four typical resolutions chosen by the investors and the host state:the host state’s jurisdiction,WTO dispute settlement,the International Centre for Settlement of Investment Disputes and arbitration.This section attempts to analyze the characteristics of different resolutions by cases and to summarize the risks of each resolution.In the fifth part,suggestions are made for investors to chose the right PPP dispute settlement resolution based on the risks listed in Part Four.The proposal is from three aspects:international legal system,domestic legal system and the perspective of Chinese enterprises as investors.The sixth part is a conclusion,briefly summarizing all the arguments of this thesis.
