On Several Controversial Issues In The Determination Of The Crime Of Drug Trafficking

The crime of drug trafficking is one of the most widespread and most harmful ones in drug crimes.The sale of drugs by criminals not only accelerates the circulation of drugs,enlarges the contact between the drugs and the public,endangers the physical and mental health of the groups,forms an industrial chain through drug sales,earns huge profits,and affects the normal order of the economic market.Many criminals also form Criminal gangs who commit crimes collectively are extremely harmful to society.Drug trafficking must be cracked down in order to safeguard social order and safety.In the judicial determination of the crime of drug trafficking,there are still many difficult issues that need to be resolved.This article uses a crime of guilty of drug trafficking as a clue,focusing on the basic drug trafficking behavior and drug purchase agency,intermediary drug trafficking in what circumstances can constitution.This article will be divided into three sections for discussion:The first section summarizes the case presentation and the focus of the dispute.On the premise of introducing the basic facts of Jia's case,the opinions of courts,public prosecutors,and defenders were summed up to form the focus of the dispute.The second part is a case review.This section is divided into two levels.The first level firstly analyzes the defendant's behavior in three aspects: from drug trafficking,drug purchasing or intermediary drug dealing and illegal drug possession.Based on the qualitative analysis of the defendant,the defendant's accusation was discussed.The third part is thinking and suggestions.By rethinking the reasons for the controversy in this case,I would like to put forward some ideas for further enhancing the relevant judicial practice in the crime of drug trafficking.
