The Identification Of The Subjects Of The Crime Of Accepting Bribes In State-owned Holding Company

With the continuous deepening of reforms of state-owned companies and companies in the equity mixed system,a large number of state-owned companies and enterprises have absorbed social capital and become state-controlled or equity-owned companies and enterprises.There are always different opinions on how to determine the status of the staff members in the state-owned holding and shareholding enterprises,both in criminal law theory and judicial practice.The author tried to elaborate and analyze the selected Lee bribery case,and then pondered the relevant legal issues,reached a conclusion,and finally put forward his own recommendations on the issue of judicial practice.This article is divided into three parts:The first part is he introduction,mainly introduces the research purpose,significance,research methods and difficulties,innovation.The second part includes the introduction of the case,the focus of the dispute and the analysis of the case.Through the real cases tried by the People's Court,the author elaborated on the understanding and understanding of the state staff and the appointed public servants prescribed in the Criminal Law,and conducted a brief analysis of Lee's bribery case around the focus of the dispute.The third part mainly draws the author's conclusion on the controversial focus of Lee's bribery case,and elaborates on the author's thoughts and suggestions on how to determine the appointment of public servants in such cases.
