Study On Cross-eexamination System Of Criminal Trial

Cross examination system is a classical system of Anglo-American law system.Trial activities to the model,emphasizing the antagonism of the court and the cross-examination system provides a specification of the prosecuting and defending parties and guidance.Introduction of cross-examination system of Anglo-American law system in our country,and in the criminal procedure law to cross-examination made relevant provision,but the rules are too principle,and no operability,also causes in the judicial practice,the cross-examination system does not play a real role.Paper,therefore,in view of our country and the cross-examination system differences between British and American law countries are analyzed,aimed to find the cross-examination system suitable to China's basic national conditions.Thesis the first part is the basic theory of criminal trial cross-examination system,provide the theoretical basis for the subsequent writing paper;Paper is compared with the second part of the cross-examination system,through the comparative study of American cross-examination system,found the cross-examination system in the United States cause sophisticated operation,and through the German introduction of cross-examination system,but did not play a real role in the analysis of the causes and find whether there are similar characteristics in our country,so as to provide experience for the improvement of the system of criminal trial cross-examination;Paper in the third part is our country in the legislative and judicial practice the paper analyses the present situation of the cross-examination system,find the problems of the cross-examination system in China;Papers at the end of the chapter on how to improve the system of criminal trial cross-examination made a comprehensive analysis,and put forward the concrete opinions.
