Research On The Connection Between Intellectual Property Administrative Protection And Judicial Protection In China

China's intellectual property protection mainly carries out the "dual track system" protection mode of administrative protection and judicial protection.In practical work,this kind of protection mode constantly exposed inefficiency,insufficient,administrative and judicial application of the two join not clear disadvantages including,especially between administrative protection and judicial protection is not a matter of cohesion.From the empirical investigation and comparative analysis,the problems arising in the process of cohesion are mainly reflected in four aspects: lack of cooperation and inefficiency in administration and justice;Inconsistent law enforcement standards;The connection between administrative law enforcement and criminal judicial transfer is not smooth;Information communication and cohesion platform is too backward.Aiming at the problems,we should focus on building online communication and information sharing platform,unified intellectual property rights protection law enforcement standard,establish a coordination mechanism of administrative law enforcement and criminal justice,build and perfect the internal information sharing platform for online and local departments of hardware facilities,the administrative and judicial protection of intellectual property between mutual coordination and cohesion,to make the intellectual property rights protected by the real,and in order to promote the legislation of the protection of intellectual property rights,enrich the protection of intellectual property rights law enforcement and the judicial practice experience,to offer a full range of intellectual property rights,legal protection environment.
