Reserch On Deficiencies And Mature Of The System Of Compensation For Divorce Damage

In realistic,A couple may divorce because of lots reasons,but when a party infringes the rights of the other party by conducting wrongful acts such as violence,cheating,bigamy,the victim can claim compensation for divorce damage according to “Marriage Law”.However,the system of compensation for divorce damage was brought to“ Marriage Law” in 2001 when amended the “Marriage Law” enacted in 1980.The mentioned system has many deficiency.Thus,this thesis analyze deficiency of the system of compensation for divorce damage and make some suggestion about how to mature it.In the first part,the thesis introduces the system of compensation for divorce damage,such as the definition and nature of the system,ethic basics and characteristics of it.In the second part,the thesis states the deficiency of the system including uncertain standard for compensation,the narrow obligation subject.In the third part,the thesis introduces the system of compensation for divorce damage in Hon Kong and Taiwan and other countries.In the last part,the author makes some suggestions on maturing the system of compensation for divorce damage.Including adding wrongful acts when applying divorce damage,make sure the standard of damage compensation,enlarge obligation subjects of compensation,and building martial damage compensation.
