Joint venture is a double-edged sword.While it has a positive influence on the competition,it also have some negative influence on competition.It may hide the "collusion" among enterprises and increase market concentration,which destroy market economic order.This article is divided into four parts.The first part introduces the connotation and extension of the joint ventures,which sets forth the two-sided of the joint ventures and the restriction on competition.Because of its complex two-sided and the destructive of competition,its legal regulation is indispensable.So I provides theoretical basis for both economics and jurisprudence.The second part introduces the background of the development of joint ventures and the status of legislation and problems.There are some general provisions in the regulation of joint ventures in China.here is no uniform definition of joint ventures,making us meeting challenges in the law enforcement process.The third part compares and analyzes the law enforcement experience and institutional framework of European and American countries.Combined with our country's practice,making the regulation of joint ventures have more Chinese characteristics.The fourth part proposes suggestions for the realities in our country and problems that arise.And build a more perfect anti-monopoly regulation framework for joint ventures.The anti-monopoly regulation of joint ventures is a complicated problem,which requires solving both theoretically and practically.There is not only theoretical significance but also of practical significance for the research on the antitrust regulation of joint ventures.This thesis offers proposals of antitrust regulation through the analysis of domestic and foreign experiences.Hoping to provide some kind of reference opinions for the law-enforcement agencies of the anti-monopoly law.
