ShareBike has recently developed based on “Internet +” mode and the concept of sharing economy.While it has brought much convenience to people,there are also some problems arising from this new mode of business,which reflect the lack of governmental regulation.This thesis enumerates the seven problems in ShareBike,which include problems of market competition of Share Bike,damage to right to life and health,damage to right of property,damage to right of privacy of consumers,infringement or accidents due to lack of right to use ShareBike,privatization or theft of ShareBike,and traffic disorder.This thesis analyzes and evaluates the current trial regulation legislation from a perspective of governmental regulation,and then raises some suggestions to the parts where government regulation does not have any effect.This thesis aims to solve the problems of ShareBike from an administrative law viewpoint.Chapter I describes the seven problems of ShareBike(as mentioned above).Chapter II describes the central and local guidance to ShareBike,and discusses the regulations to the seven problems in Chapter I.Specifically speaking,regarding the problem of market competition,the guidance suggests to establish a fair market competition order and control the total numbers of the bikes.In regard to the problem of damage to right of life and health,the guidance advises the government to encourage a higher standard of product quality standard.In connection with the problem of damage to right of property,the guidance suggests the financial regulation departments take responsibility.With connection to the problem of damage to right of privacy,the guidance advises the network and communication department to be in charge.With regard to the problem of infringement or accidents due to lack of right to use ShareBike,the guidance asks the government to keep an eye on the companies and make sure they do not provide service to anyone below the age of 12.As for the problem of privatization or theft of ShareBike,the guidance suggests conduct ex post regulation.In order to solve the problem of traffic disorder,the guidance advises the government to build the slow traffic network and add more space to bikes.Chapter III evaluates the regulation measures adopted by local governments,and the trial regulation legislation.Chapter IV gives advises to the parts where current regulation does not have enough effect.
