Study On The Problem Of Environmental Criminal Responsibility In China

Since the second industrial revolution,industrialization has been developing rapidly,and the natural environment of human existence has changed rapidly.However,human beings are facing the dangers of more and more nature while enjoying highly civilized material life.The atmosphere,water and soil that people live on are at risk of being polluted.And when the environmental disaster strikes,both developed and developing countries suffer.The oil spill in Louisiana in the last century was a devastating blow to the lives of tens of thousands of fishermen.The lack of awareness of environmental protection has led to the emergence of natural disasters,which in the last century resulted in the lurid and uneventful disasters of eight public hazards.After the reform and opening up in Chin,the rapid development of economy at the same time,but blindly pursuing economic benefits,and a plant,China has gradually become the factory of the world,made in China into the homes of the people in the world.People are not aware of the environmental protection and governance.Environmental governance has come to the point where it is urgent,lawmakers began to enact laws,use legal system to protect the safety of the ecological environmental has become a priority in legislation in our country.Environmental criminal responsibility is an important part of criminal law theory,it is to show environmental criminal responsibility is refers to the field of protection,citizen or legal person intentionally or negligently implemented a serious pollution or destruction of the environment,major person casualties or belongings loss,criminal offence constitutes a crime deal with criminal sanctions by the legal responsibility.Unlike the criminal responsibility of the criminal law,it has more strict liability.This paper is divided into five parts:the first part is the introduction,the research background,the purpose and the meaning of the research,the research status and the research methods.The second part is an overview of the environmental criminal responsibility,and introduces the basic situation concept of environmental criminal responsibility.The third part introduces the legislative,judicial and law enforcement of environmental criminal responsibility.The fourth part introduces the legislation of environmental criminal responsibility in four developed countries in Britain,the United States,Germany and Japan.The fifth part raises the suggestion that the theory and legislation of environmental criminal responsibility should be improved.
