The Legal Analysis Of The Data Problem In The Remote Sensing Principle

With the continuous development of remote sensing technology,the acquisition,distribution and transfer of remote sensing data are also getting more and more attention,While countries use remote sensing data to obtain very accurate military,environmental,meteorological and other information,but also had to face a variety of conflicts of interest due to the remote sensing data.Due to the different ability of countries participating in remote sensing,remote sensing is not limited to national territory,resulting in various countries on the issue of remote sensing data are difficult to reach a consensus.In 1986 the United Nations adopted a resolution on the principle of remote sensing of the earth from outer space(referred to as the principle of remote sensing),and gave a relatively complete set of relevant issues related to remote sensing.This paper will combine the international legal regulations and practice to analysis the remote sensing principle,summarizes some of the principles of remote sensing data,and put forward the difficulties,at the end of the paper,the author thinks of some relatively reasonable suggestions.The first part is to introduce the principle of remote sensing,include the drafting background and process,and display of national efforts and national issues while drafting principles,followed by an analysis of the nature of the principle of sensing,Grasp its effectiveness.Finally,organize and analyze the focus problem.The second part is the analysis on several main problems of law,including“permission” "data acquisition principle" "non discriminatory principle" and so on.Introduce the background of each problem and analyze the problem.The third part,this paper will Put forward suggestions from three aspects,namely Accelerate the unification of legislation ? Increase the provisions of Chapter ? Clear imputation principle.The innovation of this article: first of all,at home and abroad on the issue of remote sensing data legal research is not thorough,less number.Secondly,from the point of view of point and purpose of the study,this paper data of remote sensing principle in the legal analysis,points out the dilemma it faced in the application process,and balancing the interests of all countries,and strive to provide the countries in the field of application of remote sensing data more fair and reasonable scheme.
