The Protection Order Of Chinese Anti-domestic Violence Law System Research

The anti-family violence law enacted in China,to curb domestic violence this social habits,protect the legitimate rights and interests of citizens,promoting the healthy and harmonious development of society is of great significance.The law in the process of legislation fully draw lessons from the continental law system and Anglo-American law system and relevant countries and regions advanced experience,especially introduced the system of habeas corpus,make this a writ read separately,not attached to the other civil litigation exists,for the protection of the rights and interests of the victim of family violence,against infringement has played a very active role.But from all over the country grass-roots court judicial practice,some problems still exist in this system,such as the rules of evidence and adoption of evidence rules,the types of protection writ is too single,unable to adapt to the complicated domestic violence cases,the courts,public security organs such as habeas corpus in the execution phase of power and responsibility is unclear,the responsibility of habeas corpus is too general,and not the introduction of criminal protection system and so on.Aiming at the problems above,this paper also simply discusses some measures to improve and perfect Suggestions,hope that with the deepening of the process of our rule of law,the system of habeas corpus can effectively play its role in the judicial practice,so as to prevent or reduce domestic violence,constantly to purify the social environment,make the whole society from domestic violence.
