Comparative Study On Educational Legal System Between China And South Korea And Its Enlightenment

This article mainly analyzes the growing process of education-related legal system in China and South Korea.The research focus can be divided into four aspects.First,we should understand the historical changes of the major changes in the educational laws in the two countries.In forming the foundations of modern education law,both countries have experienced a period of severe chaos.The formation of China's education law can be divided into three stages.Overcoming the chaotic period after the founding of China's education legal system and the legal construction of education in the 1960 s and the 1960 s,have experienced the stage of reconstruction and healthy development of education after 1980.Since its founding,the government of Korea has experienced a stalled period of educational development.From the 1960 s to the 1970 s,South Korea established its current legal education system by emphasizing the growth of education quality and reorganizing the landmark legal education system The fundamental law of educationthe Basic Law for Education in Korea,was enacted and implemented in 1997.Second,in the system of educational law and educational law in the two countries,the law of education in China is formulated to adapt to the rapid social changes in development and changes and to realize the rapid adaptation to the changes in the education sector.Since the founding of New China In the absence of the full establishment of the Education Act,the lowerlevel regulations have been given priority and have been put into operation.Such on-site experience and necessity have brought great help to the formation of China's education legal system.Since then,the program for the rejuvenation of education has been initiated and a comprehensive revised law of compulsory education was enacted in 2004,which has greatly contributed to the guarantee of the educational rights of all citizens and the equalization of educational opportunities.Since the founding of the People's Republic of Korea,South Korea has formulated the educational statutory doctrine which has determined all the provisions concerning education,formulated the Basic Law of Education,which is the supreme law of education,and formulated the planning process for the elaboration of the lower-level detailed decree concerning education.Thirdly,in the constitutions of China and South Korea,both the two countries emphasize the guarantee of the right to education of their citizens and equal educational opportunities in the provisions on the protection of the basic rights of education.In particular,the concept of the right to education in China is not merely a negative concept of the prohibition of discrimination in education,but it is also that the state actively expands educational facilities and provides equal education to the handicapped and the underprivileged,poor areas and ethnic minority areas Positive concept.In order to guarantee the right to education,South Korea wrote the express provisions of the principle of unpaid compulsory education into the constitution.Fourthly,the basic principle of public education stipulated in the Basic Law of Education,the guarantee of the rights guaranteed by education,the compulsory and unpaid education of education,and the contents of the rights of the parties involved in education.China'scompulsory education law,which was fully revised in 2006,clearly stipulates the responsibility and public character of the country.In 2002,South Korea implemented secondary school compulsory education for agricultural,fishing and fishing villages and remote island areas.In 2004,it implemented compulsory and compulsory education for all secondary school students.Although the whole content has been briefly explained,the overall policy of the two countries,though they have in common,has many differences in detail.We hope that in the future,when the two countries carry out the improvement of education-related laws,the enlightenment and merits of both parties will be very helpful to each other.
