Research On The Problems And Countermeasures Of The Performance Of The Panjin Municipal People's Congress

In November 2013,the Party in the third Plenary Session of the 18^th CPC Central Committee adopted the“Decision of the CPC Central Committee on Some Major Issues Concerning Comprehensively Deepening Reform.”This was requested to strengthen ties between the NCP Standing Committee and the NPC deputies,and give full play to the role of the deputies.In October 2014 the Party adopted the decision of the Central Committee of the CPC on several major issues concerning the promotion of the rule of law in the fourth Plenary Session of the 18^th CPC Central Committee,and once again pointed out that the status of the people as the main body should be adhered to.In October 2017,General Secretary Xi once again put forward at the 19th National Congress of the Communist Party of China:"We need to strengthen people's ownership of the system,support and ensure that the deputies of the National People's Congress can be given a better play so that people's congresses at all levels and their standing committees become the representative body that maintains close contact with the the people.The people are the main body and power source of the rule of law,and the people's Congress system is the fundamental political system to ensure the people's ownership.It is of positive significance to strengthen the performance of deputies to promote democracy in Panjin,to better meet the expectations of the citizens,and to strengthen the construction of democracy and the rule of law in Panjin.This thesis utilizes theoretical research,literature research,empirical analysis,and systematic analysis methods,and of the overall understanding of the“constitution”,“electoral law”,“organization law”,and“representation law”,as well as the general requirements of the National People's Congress to examine in-depth the basic Information of Panjin Municipal NPC deputies,and the system's rules for performing their duties etc.Through study and the analysis of situations about deputies'performance of their duties during two periods,i.e.the Panjin Municipal People's Congress and the Intersessional period.This thesis has uncovered four problems existing in the Panjin Municipal People's Congress deputies'performance of their duties.First,representatives do not pay attention to activities which require their participation in meetings,investigations and group activities.Second,representatives disengage the people and create a lack of close communication with voters and have a slow response to public opinion.Thirdly,the quality of many of the suggestions and proposals put forward by representatives are inadequate and inconsequential.Lastly,representatives lack consciousness about their duties and responsibilities.Self-awareness of their rights and obligations is not sufficient.To solve the above problems,this paper recommends focusing on four aspects:Improving the supervision mechanism and adding incentives for the NPC deputies to enhance their performance;prompting the delegates to communicate with the masses;strengthening training on how to adequately perform their duties;and enhancing external environmental protection for them to perform their duties.Not only is it concerned with the positive incentives for the enhancement of the performance of deputies,it also introduces reverse incentives on the poor performance of deputies.The establishment of related systems of deputies can be“promoted or demoted”.Through these means,the aim is to strengthen the legitimate,lawful and effective performance of deputies,and to better represent the people when exercising state power.
