The Research On The Protection Of Environmental Refugees' Rights

With the continuous improvement of humans' ability to transform nature and the continuous development of the global economy,the environmental problems in the world today are becoming increas4 ingly prom inent.They are mainly manifested in global warming,sea level rise,severe desertification,frequent extreme weather,drought,and shortage of water resources.Severe environmental problems have caused human society to create a new type of refugee,namely environmental refugees.The generation of environmental refugees has forced human society to re-examine the relat ionship between humans and the environment.Environmental refugees cannot be targeted for protection because they are not protected by the current international refugee legal system.In view of this current situation,this paper tries to protect the rights of environmental refugees as a starting point,starting from the perspective of international law,examining the relevant provisions of existing internat ional law and the internat ional community's responsibilit ies for environmental refugees,by analyzing the embarrassing predicament of the international legal status faced by environmental refugees and the problems existing in protecting their rights,a series of effective ways to protect the rights of environmental refugees are proposed.This article discusses the protection of the rights of environmental refugees through the methods of conceptual analys is,case analysis,law analysis,and value analysis,and is divided into four parts:Part One: Overview of environmental refugees.First,the definition of refugees was introduced.Then the concept of environmental refugees was discussed.After analysis,the author gave the definit ion of environmental refugees.This section also analyzes the concept of environmental refugees and environmental immigrants,analyzes the causes of environmental refugees and the status of environmental refugees,and discusses the content of environmental refugees' rights.Part Two: The theoretical basis and legal basis for the protection of environmental refugees' rights.This part lays the foundation for the countermeasures for the protection of the rights of environmental refugees.Part Three: The problems existing in the protec tion of environmental refugees' rights.The main problems in the protection of the rights of environmental refugees are the lack of relevant internat ional legis lat ion and many deficiencies in the implementat ion.Part Four: Countermeasures for the protection of the environmental refugee rights.This section separately addresses the legal aspects and implementat ion aspects of environmental refugees' rights protection.
