A Study On The System Of Administrative Agency Performance

With the introduction of the Administrative Compulsory Law,the administrative enforcement system in China has been basically established.Where acting as an administrative enforcement means,the third section in chapter 4 has made the special stipulation about by clarifying its basic question with still the lack of the concrete standard in the application process and many loopholes in the legal practice Regarding a typical case of acting as the visual angle and synthetically compareing the domestic and foreign legislation present situation,this article closely combines the practice to carry oout the thorough discussion about the main body confirmation,the procedure safeguard and so on the related question of agency performance system in our country.This paper analyzes on the problems to be solved urgently in the system of agency performance in our country,and puts forward some suggestions to improve,which includes the establishment of the third party as the main body and the administration organ as the supplementary,and the third person's choice should satisfy the corresponding qualification,abiding by the rules of procedure and cost dispute settlement mechanism.This paper is divided into four parts.The first part is the introduction of the basic situation of the case,which elaborates about the case and court decisions and summarizes the focus of the case dispute.The second part combs the current legislative status of our country's agency performance system of the case dispute focus and sums up the problems facing the system of agency performance on the basis of the analysis of the case dispute focus.The third part analyzes the main body and content,the procedure rules,the collection of fees and the ways of relief in combination with the domestic and foreign legislation.The fourth part combines with the foregoing analysis to improve the performance system of our country to put forward several suggestions,including the establishment of agency performance of the main body,the improvement of agency performance procedures,the regulation of agency performance costs dispute resolution,unimpeded agency performance of different stages of relief.
