The Applicable Research On Implied License In The Determination Of Copyright Infringement

With the rapid development of social economy and scientific technology,more and more works have been disseminated through the Internet.However,the traditional “authorized and then used” copyright licensing model has been unable to meet the needs of “mass authorization” in the digital environment.This has led to difficulties in its application and has led to a variety of novel copyright licensing models.In addition,the traditional way of restricting copyright rights is difficult to deal with the issue of infringement under the network environment,and it cannot balance the interest relationship between the copyright owner and the user of the work or the intermediary.Therefore,implicit permission should be introduced into the copyright field to balance the interest relationship between the copyright owner and the public.Implied license as a licensing model is more adapted to the development trend of the network environment and the public's demand for copyright licensing.However,so far,China has not explicitly established the copyright implied licensing system.At present,there are many problems with our country's copyright implied license.First,there is no unified and harmonized system of copyright implied licenses.It is only scattered in individual laws,such as the provision of implied licenses for network poverty alleviation.Second,the scope of application is relatively narrow.At present,only the traditional copyright fields have been stipulated.For example,the reprinting and excerpting of newspapers and periodicals,and the licensed use of audio recordings,have not made corresponding legislative provisions in the copyright field under the network environment.This is inconsistent with the current social development trend and cannot meet the needs of the general public for the use of copyrighted licenses.It is a lack of effective protection mechanism.It does not require the copyright owner to raise objections to the payment of remuneration from the user of the work,nor does it require the copyright owner to revoke the right to use the license,and thus cannot protect the legitimate rights and interests of the copyright owner.Based on this,this paper uses the implied license in the determination of the copyright infringement as the research object,combines the problems of implicit permission,absorbs the advanced value concept from the outside,and continuously perfects the application of the copyright implied license.First,it defines the concept of copyright implied license,analyzes the characteristics and value of copyright implied license,and provides a theoretical basis for the application of implied license in the determination of copyright infringement.Secondly,through the analysis of the current situation and typical cases of copyright implied licenses,the authorfinds out the existing problems in order to improve the application of copyright implied license in China.At the same time,it analyzes the legislative status of copyright implied licenses,thus providing a legal basis for the application of copyright implied licenses.Once again,the relevant legislation on the implicit permission of copyrights outside the domain was examined.Through comparative analysis of the similarities and differences between the legal permission of the common law system and the civil law system,the interpretation of the value concept of the implied license of the copyright of the two major legal systems is explained and thus provided examples for our own legal system.Finally,suggestions are put forward to improve the application of the implied license of copyright in China.The main purpose is to clarify the concept of implied license,applicable standards and scope of application,to constantly improve the protection mechanism for copyright holders,and finally to establish a system of copyright implied permission.
