Study On The Copyright Of Remixing Works

With the development of digital technology in the era of web 2.0,more people participate in the creation and circulation of remixing works along with the population of the remixing creation and recreation by the users of the social networks,derivative products of which are different kind of movie critics,user's song list,database works.The remixing works and creation has not been defined specified under the existing law or in the copyright law system of China.However,the theoretical study on the issue of remixing creation has seldom been conducted in the law field.In view of the significance of study on the parody work <murder caused by a steam bun> in the law field and the similarity between remixing works and parody works,it is important to study remixing works.In this thesis,remixing creation works,the concerned torts issue and the improvement on the copyright law system shall be analyzed separately by document analysis method,caseanalysismethod and comparative approach.Other rights entitled to the copyrighter stipulated in the copyright law should apply to the remixing creation due to the right of adaption of the special use method of works in it.The remixing works composed of necessary elements parts,protected under the copyright law,might be involved in torts issues,such as the right of integrity,the right of reproduction,the right of adaption and other patent rights.Since recreation works created in huge quantities violate the rights of the original author and the enthusiasm of the remixing creation is discouraged,the response on the above should be given in copyright system of China,fair use rules be improved and transformative use be localized in consideration of marketing and creative commons mode be introduced.
