Physical education teachers in colleges and universities as the subjects of college physical education work in the current climate,of physical education in colleges and universities should not only engaged in physical education teaching,but also to participate in sports training,both sports scientific research work at the same time,its importance is increasingly prominent.In recent years,the related teachers' rights and interests protection research become the field of education especially control a hot issue,the legitimate rights and interests of college PE teachers,however,has less than due protection,the explicit and implicit infringes the rights of college PE teachers events occur frequently.PE teachers' individual consciousness and the legal knowledge is relatively weak,and human rights organizations and channels,caused the college PE teachers' lawful rights and interests are violated.So,at this stage of the ordinary university sports teachers' rights and interests protection is particularly important in terms of content and implementation of,this is to increase teachers' working enthusiasm,improve the teaching quality,promote social development inevitable trend.This paper USES the literature material method,questionnaire survey method,interview method,comparative analysis and other methods,according to China's relevant laws and regulations to protect the lawful rights and interests of physical education teachers comprehensive research and organize related content,to respondents in sports teachers feedback infringement by factor analysis,and combining with the relevant academic point of view,so as to explore more effective and more fully to the maintenance of the rights of college PE teachers,and puts forward Suggestions and ideas of human rights,investigation results show that:1.College PE teachers' rights and interests guarantee is the basis of the stability and development of college PE teachers, but also promote the main scientific research personnel, sports scientific research in colleges and universities to strengthen the legal status of PE teachers in colleges and universities at the same time, also reasonable maintenance sports teachers' basic rights.2.College PE teachers' rights and interests safeguard mechanism is not sound in China, the unreasonable,in the choice of management form,the allocation of the set of management institutions and personnel are flawed.Teachers in the process of human rights,China's relevant laws and regulations of the program have nothing to refine and perfect,caused the lack of college PE teachers' rights and interests maintenance.To clear PE teachers' rights protection way from the Angle of legislation,widen the channel of the legal relief.3.School union not to the right of teachers give full play to come out, so that teachers' rights and interests not fully implemented.The university trade union organizations should strengthen PE teachers' rights and interests protection research work.4.College PE teachers' rights consciousness is weak,the relatively poor ability of legal affairs,college PE teachers' scientific research rights,organize training,and participate in the competition,the education of teachers teaching rights,subject status and professional special rights are subject to different degree.Schools and society should strengthen the franco-prussian propaganda,when the infringement of the right of sports teachers' legitimate rights and interests,should be advocated and encouraged a petition or suit according to law, use the law to uphold the people's teacher's professional dignity.5.From the Angle of legislation,and gradually perfect the legislation and system construction is the basis of college PE teachers' rights.Procedure guarantee and relief way lack of existing laws and regulations,must clearly rights of way,conditions and to appeal and review, standardize the legislative process of higher education.
