When competition and cooperation occur in the compensation for career injury ensurance and the compensation for the infringement of the third party,there arises the circumstance where both request rights exist.While there is presently no clear regulatin on the appliccle relationship of them.Various places also have different regulations.In judicial practice there arises the phenomenom where similar cases have distinctive judgements,leading to disvantageous influence on the judicial authoritativeness.The paper analyzes the issue of through collecting the cases of jurisdiction files in China and integrates the current condition in Chinese law in the analysis of the competition and cooperation issue for compensation of infringement by the third party.The thesis is mainly divided into four chapters:Chapter one researches the theory of compensation for career injury and the infringement of the third party.analyzes the difference of the two parties in,highlighting the research significance of the topic.Chapter two studies the cases of career injury and the third party and analyzes the result and reasons of the judgement.The third chapter conducts deductive analysis on the articles on the competition and cooperation issue between the compensation for career injury ensurance and the infringement of the third party in China.The ambiguous legislative attitude at the central level may cause dispute,disparity of local legislature leading to chaotic applicable judicial mode.The fourth chapter analyzes and demonstrates the four modes adopted in the competition and cooperation of compensation for infringement on the rights by the third party.In China,the mode of part and should be used in competition and cooperation.
