Research On Injured Workers Rights Relief In Case Of Construction Illegal Subcontract

As is known to all,the construction industry is an area with frequent accidents in our country.And there are a lot of irregular phenomenon in the industry,including without limitation,illegal subcontracting and layers of the subcontract and etc.Although there are several terms regulated in Construction Law of the People's Republic of China and Work Safety Law of the People's Republic of China and other related laws,have banned such circumstances,the general contractor and other subcontractors will try their best to further subcontract the project in order to decrease the cost and make more profits.And in most cases,the project is subcontracted to individuals and units without any qualification,which results to the phenomenon that several individuals without qualification lead some workers to execute the construction in reality.As to the lacking of qualification,the leaders can not supply enough labor security to protect workers' safety.As a result,the accidents occurred frequently.After the occurrence of occupational accident,most workers do not realize that they can relieve their rights through legal approaches.And there are large numbers of and contradictory regulations on the issue,the workers will be confused when facing the regulations.Hereto,the relief gets stuck in the reality obstacles.Therefore,in this paper,I will summarize the main problems when the injured workers are relieving their rights,and analysis the deep reason and provide some advice on the issue.
