On The Construction Of Mandatory Catastrophe Insurance Legal System

In 2006, the China Insurance Regulatory Commission drafted " a program on the establishment and improvement of catastrophe insurance system," and proposed to establish catastrophe insurance system. However, the voice on the establishment of catastrophe insurance system was not gradually increased until the South snow disasters and the Wenchuan earthquake taking place in 2008. In November 2012, CIRC Chairman Xiang Junbo said in public that we should accelerate the establishment of a catastrophe insurance system in the insurance industry in the future. Catastrophe insurance system in many countries was very mature and Chinese scholars had written many articles in this field. This article summarizes my own envisage about establishing catastrophe insurance Construction on the recent background. I hope it will have some effect on the construction of our catastrophe insurance system in the future.It is specifically divided into three parts from the choice of catastrophe insurance system mode. The first part of this paper is to write our catastrophe insurance mode selection. Through comparing about three existing modes, I draw some advantages on mandatory catastrophe insurance and I did some research to show the needs and basis on the establishment of mandatory catastrophe insurance. The second part of this paper is to write the guidelines in establishing our mandatory catastrophe insurance system. I discussed the guiding principles for the establishment of a mandatory catastrophe insurance system in China in detail The third part of this paper is to write our catastrophe insurance elements of the legal relationship. This section describes the underwriting, insurance and rights & obligations in catastrophe insurance from the object and content about the body of the legal relationship.This article discusses the forms completely of the mandatory catastrophe insurance on our legal system from the force mode, and makes a more detailed discussion in the part of legal relations on catastrophe insurance compulsory legal system. Taking into account China's national conditions and our past practice for catastrophe relief, it will be very difficult to build this legal system in the future. But I believe that since China has established a variety of compulsory insurance and social insurance, We can learn from those experiences. It is a trend to establish mandatory catastrophe insurance system.
