Research On Legal Issues Of PPP Model In China

In recent years,Government and social capital cooperation(PPP)projects continued to heat up,it has also been strongly supported at the national level.Amendment to the constitution of the state of non-public economy,Provides the basic legal protection for the non-public economy and the private sector in infrastructure and public utilities.Under the impetus of constitutional spirit,National legislation,relevant departments of the State Council,and inter-local governments have also amend the existing laws or introduced various policies and regulations to eliminate the institutional obstacles,and promote the application of PPP mode in public projects.Nevertheless,the technology and standards of PPP projects in China have many places need to be improved,especially for our country’s "heavy entity,light procedure" habit.We need to further refine the contract awards,procedures,standards of PPP project.China is becoming more and more in line with the world,our legal standards should be also.In the process of the development of PPP in the world,Britain is not only the pioneer but also the demonstration.In terms of quantity or amount of the PPP projects in Britain today are far ahead of the in the rest of the world.Therefore,the aim of this paper is to refer to the law and practical experience of the United Kingdom and other countries,combined with our country’s actual legislation situation,put forward the corresponding countermeasure to solve the problem of the PPP system in our country.This paper aims to improve the domestic legislation of PPP project by recommendations to improve the competitive negotiation system and Operators to enter the exit mechanism,Absorb the most economic favorable targets(MEAT)principles,the establishment of PPP exclusive agencies and other measures so that PPP project will have the perfect legal protection in the future operation.
