Analysis Of Issues Related To Judicial Practice Of Drunk Driving And Dangerous Driving

Since the crime of dangerous driving was written into Criminal Law on May 1, 2011, in dealing with drunken driving, one kind of dangerous driving, judicial organs found many problems in evidence collecting, fact finding, application of law and etc. In order to provide useful references for handling dangerous driving cases, the paper studies the problems in the crime of drunken driving in judicial practice, and suggests relevant resolutions in correctly mastering conviction standard of drunken driving, cautiously commanding key evidences in conviction and sentence, and rationally comprehending judicial interpretations.The paper consists of the following four parts:The first part is the introduction, which briefly describes the current judicial situation of the dangerous driving crimes and the author’s purpose of writing.The second part gives the general description and relevant legal problems of drunken driving case.The third part analyses the problems existing in dealing the drunken driving case.The fourth part proposes solutions to the present problems in dealing with the drunken driving case, and summarizes this paper.
