Research On Contract Fraud Crimes

In this paper the author belongs to the prosecution of criminal cases, the crime of contract fraud is controversial, difficult to handle the types of cases, both pleadings tend to revolve around the "there is subjective purpose of illegal possession purpose", "the purpose of illegal possession" point of time ", people involved in the case before and after the contract funds chain", the case involving "civil disputes or criminal responsibility" is controversial, but in judicial practice, procuratorial organs and public security organs, the court on the case itself is more than the legal communication constitute crime of government intervention, more than the legal paper, caused confusion of actual officers of the crime, more or less affected the identification the crime of contract fraud.This paper chooses to study the problem of the crime of contract fraud, through the analysis of the two cases involved in the actual occurrence of the problem, to clarify the differences between the civil and criminal, and analyze the differences between the subjective and objective standards, to provide useful reference for the judicial practice of the crime.
