In the period of rapid development of society, China has entered the era of litigation explosion, growing all types of litigation. However, due to lack of investment at this stage of judicial resources, limited public funds, how to save the cost of litigation, to maximize the benefits of litigation, litigation achieve cost minimization will become a priority. Especially as China to further reform judicial trial centrism, in handling criminal mystery or misjudged the process, reduce unnecessary litigation costs, litigation costs and balance the fairness of the verdict, protect the legitimate rights and interests, safeguard judicial authority becomes extremely important. In the "Nie Shubin case", the entire case has gone through complex and lengthy trial and review processes, specifically public security organs, the parties and their families have spent a huge cost of criminal proceedings, but the final decision and review the result was unsatisfactory, costs and not in proportion between harvest and led to the integrity of the judicial crisis. Therefore, how to balance the cost of litigation and the fairness of the verdict has become an important research question. In "Nie Shubin case" as the starting point, from the origin of the existence of litigation costs consume a lot of problems as a starting point analysis criminal mystery, litigation costs misjudged, to provide some reference for future judicial practice department can handle similar cases.
