Research On The Characteristics Of Legal System Construction In Revolutionary Base Areas

Despite only a short 20 years of history, the legal system in the areas of Chinese revolutionary base, has achieved remarkable accomplishments, accumulating historical experience for the formation of the legal system for socialism, providing a theoretical basis, and basically giving birth to the new Chinese legal system, which has important theoretical values and significance.The development of the legal system in the areas of Chinese revolutionary base, has gone through several of the most important stages as follows: the Central Soviet workers and peasants democratic regime during the Second Revolutionary War, Sino-Japanese War Shaanxi-Gansu-Japanese democratic regime the legal system, the War of Liberation of Northeast Liberated Area(including Harbin liberated area) and the legal system in North China Liberated.The legal systems of these stages mentioned above have very distinctive characteristics, which have profound influence on the construction of New China's legal system. Meanwhile, we found, by comparison, that although at different times, in different stages, and with the goal, task, and situations being different as well, generally speaking it is the same strain.In other words, the legal system in the areas of Chinese revolutionary base is developed on the basis of the legal system and the results of the previous experience. Thus, by careful study of different characteristics of ideas, and contents of legislation as well as the characteristics of judicial construction at diverse stages, we can find the basic context of the development of the legal system construction in the areas of Chinese revolutionary, exploring the laws of inheritance, evolving revolutionary base spirit of the legal system, and summing up the experience of legal construction in the areas of Chinese revolutionary base, which have given great guidance for building socialism subject to rule of law.At the same time, based on the general tendency, the priority for the development of the legal system in the areas of Chinese revolutionary base is basically corresponding to the path of the development of the Chinese revolution coincide, which is also called "from the countryside to the cities."
